Description of Service GymBoyo is a gym management platform providing: - Member management and tracking - Payment processing and billing - Class scheduling and booking - Staff management tools - Analytics and reporting - WhatsApp reminders and communications - Mobile app access We reserve the right to modify, suspend, or discontinue any part of the service at any time without notice. --- ## 3. User Accounts When you create an account, you agree to: - Provide accurate, current, and complete information - Maintain and promptly update your account information - Keep your password secure and confidential - Notify us immediately of any unauthorized access to your account - Accept responsibility for all activity that occurs under your account --- ## 4. Subscription and Payment GymBoyo offers subscription-based access. By subscribing, you agree to the following: - Subscriptions automatically renew at the end of each billing period - We will provide at least 30 days' notice before any price changes take effect - No refunds are provided for partial billing periods - Accepted payment methods include credit/debit cards and other methods as specified on the platform - You are responsible for all taxes applicable to your subscription --- ## 6. Intellectual Property The GymBoyo platform, including its original content, features, design, and functionality, is owned by GymBoyo and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our platform without our express written permission. You retain full ownership of all data you enter into GymBoyo. We do not claim any rights to your gym's data. --- ## 7. Privacy and Data Protection Your use of GymBoyo is also governed by our [Privacy Policy](/privacy.md), which is incorporated into these Terms of Service by reference. Please review it to understand our data practices. --- ## 8. Service Availability We strive to provide reliable, uninterrupted access to GymBoyo, but we cannot guarantee 100% uptime. Scheduled maintenance or unplanned outages may temporarily affect availability. We will provide reasonable advance notice for planned maintenance where possible. --- ## 9. Termination Either party may terminate the service relationship at any time: - You may cancel your account at any time through your account settings - We will provide 30 days' notice before terminating your account with or without cause - We may terminate your account immediately for violations of these Terms - Upon termination, your access to the platform will cease and your data will be handled per our Privacy Policy --- ## 10. Indemnification You agree to indemnify and hold harmless GymBoyo, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the service, your violation of these Terms, or your violation of any rights of a third party. --- ## 12. Governing Law These Terms of Service shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Chennai, Tamil Nadu, India. --- ## 13. Changes to Terms We may update these Terms of Service from time to time. We will notify you of material changes via email or a prominent notice within the platform before the changes take effect.
